Smith Shield Moot

The Smith Shield Moot is a not-for-credit exhibition that sees two teams of two student advocates argue a hypothetical appeal before a panel of lawyers, judges, and members of the Weldon community.

It is the premiere mooting event of the academic calendar with a tradition dating back to 1927 and being selected to participate is a significant accolade.

The Case:

Sylvia Vaughn v. Derrick Chandler

When and how should a person have control over their images and personal information?

Ms. Sylvia Vaughn runs a personal camgirl website where she livestreams herself in the nude engaging in sexual behaviours for the people viewing the session.

Recently the defendant Mr. Derrick Chandler, another parent from her son’s school, sent screenshots of her nude images to the principal, teachers, and members of her son’s school board. After this incident Mr. Chandler used one of the images he had screenshotted of Ms. Vaughn along with her name on the cover of an e-book he was selling about how to advocate against sexual images online.

Ms. Vaughn commenced an action under the Intimate Images and Cyber-Protection Act, claiming that her intimate images were distributed without her consent. She also brought an action under the tort of appropriation of personality.

The Legal Issues:

The Supreme Moot Court of мÓÆÂÁùºÏ²Ê¿ª½±Ö±²¥ will decide if the Intimate Images and Cyber-Protection Act applies to the defendant’s emails containing the plaintiff’s images, and if the plaintiff has a reasonable expectation of privacy in her intimate images.

The Court will also consider if the tort of appropriation of personality applies to the book the defendant sold with the plaintiff’s name, image, and story.

The Mooters:

  • Alex Harrison
  • Machel Maxwell
  • Rachel McMillan
  • Anu Sidhu
  • David Gouws (Alternate)

The Judges:

  • The Honourable Justice Robin C.M. Gogan, Nova Scotia Court of Appeal
